Please read the following Terms and Conditions ("Terms") carefully before completing your purchase or membership registration. By becoming a member online, you acknowledge and accept these Terms and Conditions in full. If you do not agree, please do not proceed with your purchase.
1. Membership and Services
By enrolling in a membership or purchasing services at The Cardio Factory, LLC ("we," "us," "our"), you gain access to cardio training equipment, classes, and other wellness offerings as described in your selected plan.
Memberships are non-transferable and are valid only for the person whose name appears on the account.
2. Payment and Billing
All prices are listed in USD and are subject to applicable taxes and fees.
Memberships are billed on a recurring basis (monthly or annually) unless otherwise specified.
By submitting payment information, you authorize us to automatically charge your selected payment method according to your membership plan.
It is your responsibility to ensure that your billing information is current and accurate.
3. Cancellation and Refunds
You may cancel your membership at any time by reaching out to our customer service at connect@thecardiofactory.com
Cancellations must be made at least 3 days before your next billing cycle to avoid additional charges.
Refunds are only provided under specific circumstances and are not guaranteed. Please review our Refund Policy for details.
4. Health and Safety
By using our facilities and services, you confirm that you are in good health and physically capable of participating in cardio fitness activities.
Please consult your physician before beginning any exercise program.
You acknowledge that participation in physical activity involves inherent risks, and you voluntarily assume full responsibility for any injuries or damages that may occur.
5. Code of Conduct
Members are expected to treat staff, fellow members, and the facility with respect.
Any form of harassment, misuse of equipment, or disruptive behavior may result in suspension or termination of your membership without refund.
6. Facility Access and Changes
We reserve the right to modify our hours, equipment, classes, or services at any time. Temporary closures (e.g., for maintenance, holidays, or emergencies) do not entitle members to a refund or credit.
7. Privacy
Your personal information is handled in accordance with our Privacy Policy. We are committed to protecting your data and will not share your information without your consent, except as required by law.
8. Limitation of Liability
The Cardio Factory, LLC is not liable for any direct or indirect injuries, losses, or damages resulting from the use of our services or facilities.
Members waive any claims against us related to participation in physical activity, use of equipment, or onsite incidents.
9. Modifications to Terms
We reserve the right to update these Terms at any time. Any changes will be effective upon posting. Continued use of services following updates constitutes your acceptance of the revised Terms.
10. Media Release and Promotion
We occasionally capture photos and videos during classes and events for use in our promotional materials, including on social media platforms and our website.
By agreeing to these Terms, you consent to the use of your image or likeness unless you notify us otherwise.
If you prefer not to be featured in any media, please inform us by email at connect@thecardiofactory.com or let a staff member know, and we will make every effort to exclude you from published content.
